Vancouver Island Brewery’s Share Your Summer Sweet Spot Contest Official Rules

1. Purpose

The Contest is intended to create awareness on why “We’ve Got it Good” on Vancouver Island, and to share the “summer sweet spots” on the island with others.

This Contest is void where prohibited by law. NO MEMBERSHIP, DONATION, PURCHASE, OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER THE CONTEST.

2. To Enter Contest

Enter the Contest by going to the Vancouver Island Brewery Facebook Contest App page at https: <need to insert link> read and agree to the Official Rules; and then follow the instructions to submit your original entry (“Entry” or “Entries”) and provide the other requested information. To enter the Contest you must have a Facebook account.

Submit a statement, photo or video in the format and of the length specified in paragraph 5 below describing why “We’ve Got it Good”.

Entry into the Contest represents your acknowledgement that you have read, understand and agree to be bound by the Official Rules in all regards, and that all decisions of Vancouver Island Brewery about the Contest are in its sole discretion and binding in all respects.

Entries may be publicly available and available to be shared on social media and the Internet. Vancouver Island Brewery, at its sole discretion, will select certain entries to be featured on its Facebook page, its Facebook Share Your Sweet Spot Contest App, its web site at www.vibrewery.com and/or in the Vancouver Island Brewery’s email newsletter.

3. Eligibility:

The Contest is open and offered to individuals who are legal residents of British Columbia, Canada at least nineteen (19) years of age or older at time of entry, who agree to comply with all terms and conditions of these Official Rules. Entries submitted by persons under the age of nineteen (19) will not be considered. Vancouver Island Brewery reserves the right to require evidence of age.

Employees, officers, and directors of Vancouver Island Brewery or its affiliated companies, agents, distributors, advertising, promotion, and production agencies, or members of their respective immediate families (parents, spouse, children, siblings) or individuals residing in their household (whether or not related) are not eligible to enter the Contest.

4. Entry Period and Prizing:

Entries may be submitted beginning May 16, 2013. Entries must be received by 5 p.m. PST on August 16, 2013. If an Entry is submitted on or before August 16, 2013 at 5 p.m. PST, the Entry will be eligible to win prizes. Entries received after that time will not be eligible. Prizing and use of any selected Entries have no monetary value.

5. Content and Form of Entry Restrictions:

Entries must relate to a location on Vancouver Island. Regardless of form – statement, video or photo – Entry should clearly articulate the location and Why We’ve Got it Good.

Entries must be in English, include correct syntax, grammar, spelling and punctuation. Entries must be thoughtful and original subject matter.

Entries may not: 1) promote illegal drugs, tobacco, firearms/weapons; 2) contain name, voice or likeness of celebrities or other public figures, nor individuals without legal permission to use any individual’s name, voice or likeness; or 3) promote any political agenda, specific legislation or any candidates for political office.

Entries may not contain material that violates or infringes another’s rights, including but not limited to any privacy, publicity or intellectual property rights, or that constitutes copyright or trademark infringement;

Entries may not disparage Vancouver Island Brewery, or any other person, entity or organization.

Entries may not contain material that is inappropriate, violent, indecent, obscene, hateful, tortious, defamatory, slanderous or libelous, or that degrades or demeans the human form, image or status of women, men or the members of any group based on race, religion, ethnic background, sexual orientation or any other minority status.

Photo Entries must be submitted in .jpg or .tiff format; not exceed 5 MB in size; and include an address, caption and description in English.

Video Entries must include a title and description in English; not exceed 5 minutes in length.

Caption entries must be no longer than 50 words in length, be in English, and have an address.

6. Original Work and Legal Right to Submit Work

By submitting an Entry to the Contest you represent and warrant that, consistent with the terms of the Official Rules: (a) the entry is your original work; (b) you own the copyright in the Entry; (c) the Entry does not violate, in whole or in part, any existing copyright, trademark or intellectual property of any other person, organization or entity; (d) any third party content included in your Entry (such as music or content) is not protected by copyright or you have a license to use the music or content for any purpose, specifically including the Contest; (e) you are unaware of any agreement that is inconsistent with the consent provided herein; (f) you are not disclosing the confidential or proprietary information of any person or entity; and (g) you have full power and all legal rights to submit an Entry. You further represent and warrant that you have legally secured the rights to publicity for any individuals named, heard or shown in any Entry and that all such persons are over the age of 19.

7. License and Right to Use Likeness to Vancouver Island Brewery

By submitting an Entry you grant permission and a worldwide, perpetual, royalty-free nonexclusive license to Vancouver Island Brewery to use, reproduce, creative derivative works, perform, display, distribute, copy, post on Facebook, and/or post on other websites or social media the Entry.  Vancouver Island Brewery shall have the right to use the Entry in any manner, and at its sole discretion, and to promote the Contest in any manner it chooses. Vancouver Island Brewery, however, has no obligation to use or otherwise promote or distribute any Entry.

By submitting an Entry, you agree and consent that Vancouver Island Brewery may use your name, likeness, statements, Entry, city and province of residence, biographical information, voice, photo and/or video to promote its Share Your Sweet Spot Contest and caption related to your Entry, worldwide and in perpetuity, in any and all forms of media and print, now known and hereafter devised, including without limitation on the Internet, without restriction as to frequency or duration, and without compensation, consideration, notification or further permission, except as prohibited by law. Such use may include, but is not limited to use on the Vancouver Island Brewery’s Facebook page, Vancouver Island Brewery’s Share Your Sweet Spot Contest Facebook app, the Vancouver Island Brewery website, use in media releases, use on other social media web sites, and use in connection with any events or activities associated with Vancouver Island Brewery.

By submitting an Entry, you agree and consent that any ideas, suggestions, and/or concepts included in your Entry will be publicly disclosed. As such, you waive all rights, claims and any cause of action that you may have against Vancouver Island Brewery or any third parties related to any ideas, suggestions and/or concepts that may be disclosed in your Entry.

8. Vancouver Island Brewery’s Sponsorship and Operation of Contest

Vancouver Island Brewery has the right to remove and disqualify any Entries without notice to the entrants in its sole discretion.

Neither Vancouver Island Brewery nor its agents are responsible for illegible, lost, stolen, late, damaged, incomplete, mutilated or misdirected Entries or for any problems or technical malfunctions related to the electronic submission of Entries. If all required information is not provided or Entry is illegible, or technically inaccessible, the Entry will be disqualified. Any Entries that do not comply with the Official Rules can be withdrawn and/or rejected, and deemed ineligible.

If, for any reason, the Contest is not capable of running as planned, Vancouver Island Brewery reserves the right in its sole discretion to cancel, terminate, modify, or suspend the Contest at any time. By entering the Contest, you acknowledge that no joint venture, partnership, employment, or agency relationship exists between you and Vancouver Island Brewery from your Entry or Vancouver Island Brewery featuring or publicizing your Entry.

9. Selection of Featured Entries

Vancouver Island Brewery, in its sole discretion will select one or more entries to be featured on its Facebook page, its Facebook Share Your Sweet Spot Contest App page, and its web site at www.vibrwery.com. While Vancouver Island Brewery will consider the top 10 captions that will go to a public vote on Entries, Vancouver Island Brewery’s selection of Entries will be guided by the strength of the Entry, the originality of the caption and contents of the Entry, and the Entry’s compliance with the other requirements of this Contest.

The decision of Vancouver Island Brewery about which entries to feature in the voting stage is final and binding. Vancouver Island Brewery will notify entrants that an Entry has been selected for the voting phase and be contacted by email as such information is made available in connection with an Entry. Vancouver Island Brewery is not responsible for any difficulty contacting entrants if an Entry has been chosen to be featured in the voting stage.

10. Release

By entering the Contest, you agree to these Official Rules and the decisions of Vancouver Island Brewery on behalf of yourself and each of your respective heirs, executors, administrators, legal representatives, successors and assigns (“Releasing Party”), and by entering, you release, defend and hold harmless Vancouver Island Brewery, its parent companies, subsidiaries, affiliates, distributors, and professional advisors, and their respective officers, directors and employees and Facebook (“Released Parties”) from any and all causes of action, suits, debts, dues, sums of money, accounts, reckonings, bonds, bills, covenants, contracts, controversies, promises, lost profits, indirect or direct damages, consequential damage, incidental damages, punitive or exemplary damages, judgments, claims and demands whosoever, in law, or equity, whether known or unknown, foreseen or unforeseen, which any Releasing Party has or may ever had, now or hereafter, arising from or related to the Contest, the preparation of any entry materials, or delivery, misdelivery, acceptance, possession, use of or inability to use any prize.

By submitting an Entry to this Contest, you acknowledge and accept that Facebook, any other social media provider or any other entity or organization associated or involved with the Contest shall not be liable to you in any way for any matter in relation to this Contest.

11. Indemnification

By entering the Contest, you agree to indemnify, defend, and hold harmless Vancouver Island Brewery, its officers, directors, employees, owners, agents and licensees from and against any and all claims, actions, demands, and liabilities, including those raised or brought by third parties, and any costs and expenses, including, without limitation, reasonable attorney and professional fees and costs and other expenses of any nature incurred in the investigation and defense of any such claims resulting from your breach of any provision of these Official Rules, or any representation or warranty you provide herein, or otherwise arising in any way out of your Entry into the Contest, whether now known or unknown, or anticipated or unanticipated. Vancouver Island Brewery reserves the right to take exclusive control and defend any such claim otherwise subject to indemnification by you, in which event you will cooperate fully with Vancouver Island Brewery in asserting any available defenses.

12. Choice of Law

The Contest shall be governed by and interpreted under Canadian law, in the Province of British Columbia without regard to conflict of law provisions. By entering the Contest, you agree that any disputes, claims, causes of action or controversies arising out of or in connection with this Contest shall be resolved by the British Columbia provincial courts, which shall have sole jurisdiction of any controversy regarding or arising from the Contest or these Official Rules. BY ENTERING THE CONTEST, YOU WAIVE ANY AND ALL OBJECTIONS TO JURISDICTION AND VENUE IN THE COURTS COVERING BRITISH COLUMBIA AND SUBMIT TO THE JURISDICTION OF THE COURTS. Further, you acknowledge and agree that you may only assert claims on your own behalf and not on behalf of any other person or entity arising from or in connection with this Contest or these Official Rules.

14. Privacy

By entering the Contest, you agree that any information provided may be used according to the terms and conditions of the Vancouver Island Brewery Terms of Use and Privacy Policy, and the Privacy Policy for this Contest, as amended from time to time (“Vancouver Island Brewery Terms”). 15. No Return of Entries

No Entries can be acknowledged or returned to Entrant or any other person. This Contest is in no way sponsored, endorsed or administered by, or associated with Facebook or any other entity or organization.
